The governing law

Belize trust law starts from one core statute, the Trusts Act, in its Revised Edition 2020.
The Financial Services Commission lists it on its page of laws and amendments, with a link to the full text.
The same list shows a 2023 amendment and two sets of regulations: the International Trusts Regulations 2007 and the Private Trust Companies Regulations 2022.

Who may act as trustee
An international trust must always have a trust agent resident in Belize, appointed by the trustee (s.65E(1)).
In practice the trustee is a trust company, and a local partner holds that role. We coordinate the papers and reporting, and the trustee decides under the deed. Which firm acts in your case is confirmed in your consultation.
You can choose other people for other roles. A protector, an investment adviser you appoint, or a co-trustee outside Belize may be possible, subject to the deed and to advice from a law firm in Belize.
We do not offer a role until that firm has confirmed it works for your structure.
Features the law allows
The features below point to drafting choices your lawyer may consider. Each one is a tool, not a result we promise.
| Feature | What the Act provides |
|---|---|
| International trust | Entered in a register the public cannot search (ss.65A, 65C) |
| Duration | Maximum 120 years from creation, except charitable trusts (s.6(1)) |
| Foreign claims | Courts do not recognise some foreign marriage, heirship and insolvency claims (s.7(6)) |
| Protective or spendthrift trust | Provided for in the Act |
| Purpose trust | Non-charitable purpose trusts with a protector |

Limits and requirements
Every feature comes with conditions, and a structure that ignores them can fail. The main points your lawyer will raise are these.
- Trust agent. An international trust needs one at all times, so the role must be filled before signing and whenever the agent changes.
- Foreign claims. The foreign-claims rule (s.7(6)) addresses courts in Belize. A court at home may reach a different view and may treat you as still owning assets you control.
- Timing of transfers. How the timing of a transfer relates to an existing or expected claim is a point your lawyer reviews before anything moves.
- Retained control. The more control you keep, the more a court at home may look through the structure.
- Records and conduct. The trustee must act under the deed in practice, with real meetings and resolutions.
We never describe a trust as making assets untouchable. The structure gives your lawyer a set of rules to work with, and outcomes depend on facts and on courts we do not control.
The steps and documents show where these checks happen during set-up.

Frequently asked questions
Which law governs a trust in Belize?
The Trusts Act, in its Revised Edition 2020, governs trusts in Belize, as the Financial Services Commission's list of laws shows. The deed names its governing law. Your lawyer confirms how the 2023 amendment applies to your deed. We coordinate the papers and reporting around it.
Who may act as trustee in Belize?
Every international trust needs a trust agent living in Belize, whom the trustee appoints (s.65E(1)). Local trust companies usually act as trustee. Your lawyer confirms who will be the agent before you sign. The deed names the trustee, and your lawyer explains each role.
Can a trust in Belize have a protector?
Yes. The deed can create a protector and set its powers, such as consenting to distributions or replacing the trustee; the Act has provisions on the role. A purpose trust relies on one, which then acts as enforcer of the purpose. A protector with wide powers tied to the settlor can weaken the structure, so your lawyer advises who holds the role.
