Belize trust: how it works and how to set one up
A Belize trust is a trust set up under the Trusts Act, Chapter 202, where a trustee holds your assets for the beneficiaries your deed names. An international trust also needs a trust agent resident in Belize. We coordinate the checks, papers and local partners with your own lawyer.

What a trust in Belize is
A trust is an arrangement under which one person, the settlor, transfers assets to a trustee. The trustee holds them for the beneficiaries the deed names or describes.
In Belize the main statute is the Trusts Act, Chapter 202, in its Revised Edition 2020. The Financial Services Commission lists it on its page of laws, together with later amendments.
The Act covers international trusts, protective or spendthrift trusts, and non-charitable purpose trusts that a protector enforces.
Your lawyer confirms how each section applies to your deed.
The Act sets a maximum of 120 years from the date a trust is created, except for charitable-only trusts (s.6(1)).
The Act provides for a register of international trusts that the public cannot search, kept by the Registrar (ss.65A, 65C).
Many deeds are discretionary. The trustee decides who receives what and when, guided by the deed and by a letter of wishes from the settlor.
The letter guides the trustee but does not bind it. Keeping it current is the simplest way to make your intentions clear.
A 2023 amendment to the Act is also listed by the Commission. Your lawyer confirms how it applies to your deed.
Who a trust in Belize suits
It suits a settlor who lives outside Belize and wants a Belize offshore trust with a statute that addresses foreign claims and a trust agent in the country. Typical users are:
- Families with assets or beneficiaries in more than one country who want one deed.
- Business founders who want family company shares held under a purpose trust.
- Multi-generation families who want a protective or spendthrift trust drafted by their lawyer.
- Advisers comparing Caribbean statutes for a client.
The Act provides that, for a trust under Belize law, courts do not recognise certain foreign-law claims and orders about marriage, inheritance and creditors in an insolvency (s.7(6)). Your lawyer confirms how that applies.
Whether that helps depends on your facts and on the court that hears the case.
Your own advisers assess that point, and the trustee is named in the deed. We never describe a trust as making assets untouchable.
Check first how your home country treats the trust for tax, whether your bank accepts the structure, and what the foreign-claims provisions mean for you.
A trust is not right for every goal. The first review may show that a will, a company or a different place suits you better.
Our jurisdiction guide places Belize beside other options, with sources for each fact.

What the trustee does
The trustee holds legal title to the assets and manages them under the deed. It keeps accounts, decides on distributions and records each decision in writing.
For an international trust, the trustee must appoint a trust agent resident in Belize. The agent keeps the trust connected to the country, and its duties are set by the Act and the deed.
Which firm acts as agent in your case is confirmed in your consultation.
A local partner takes a defined role in the structure. We prepare the papers and keep your lawyer, the partner and your bank in step.
Our part is to run the identity checks, collect the documents and prepare the structure with your lawyer. The partner makes the trustee decisions and keeps the formal records.
This split matters when something changes, such as a distribution, a new beneficiary or a different protector. You send us the request, we prepare the papers, and the trustee decides under the deed.
The settlor, or a manager the settlor appoints, may advise on investments within limits set by the deed. Your lawyer checks how much control you can keep without weakening the arrangement.
We suggest a review each year and another whenever your family or assets change. A marriage, a birth, a move or the sale of a business all count.
Documents and steps to start
The set-up runs in a fixed order, and nothing is signed until your lawyer has reviewed the deed. The order is:
- Enquiry, then client acceptance and identity checks.
- Design of the structure with your lawyer, including any holding company.
- Drafting of the deed and your letter of wishes.
- Signing, acceptance by the trustee and entry in the register.
- Transfer of assets to the trustee or to a company the trust owns.
We ask first for identity documents, proof of address, evidence of the source of funds and wealth, and details of each beneficiary and of the protector.
After that, timing depends on third parties: your lawyer, the trustee, the trust agent and the bank. We give you a checklist and a list of open items, not a promised date.
A missing bank letter can hold up every later step, which is why gathering the evidence early saves the most time.
The step-by-step set-up guide lists the documents and the order of the steps. What it costs depends on the shape of the structure; the cost guide explains what drives the total.
We publish the set-up fee for a standard trust; annual administration, event-based work and third-party charges are quoted after we review your case.
Tax follows the people, not only the trust. The page on tax and reporting shows what to ask your adviser.

Frequently asked questions
Who can set up a trust in Belize?
An international trust suits a settlor who lives outside Belize and has assets to place in trust. Where you live matters less than your home rules on tax and reporting, so your lawyer and tax adviser confirm the structure suits you before anything is signed. Tell us where you live in your first message.
How do I start in Belize?
Write down who should benefit, what you plan to transfer and who advises you. Then send us a short message with your country of residence. We reply with a document list and a quote, and we line up the local partner who acts as trust agent.
Who can help me start in Belize?
You need a lawyer of your own, a trustee and trust agent in Belize, and a tax adviser at home. We coordinate the checks and papers between them. Legal advice stays with your lawyer, and trustee decisions stay with the trustee.
What is a trust agent in Belize?
A trust agent is a person resident in Belize whom the trustee appoints. Under the Trusts Act, Chapter 202, an international trust must always have one (s.65E(1)). Who acts in your case, and how that fits our local partner, is confirmed in your consultation.
Is the register of international trusts public?
The Registrar keeps a register of international trusts that is not open to the public (ss.65A, 65C of the Trusts Act). That means a member of the public cannot search it for your trust by name. Your lawyer confirms what the register records and who may see it, and we prepare the papers that go with the registration.
