Basics

In Barbados, as elsewhere in common law countries, the pattern is the same. The settlor passes assets across, the trustee holds them and the deed names who may benefit.
What makes the Barbados trust distinct lies in the legislation behind it and the conditions that follow. The law page lists these rules and sources.
You may hear such trusts called protective. Treat that as a description of provisions in the legislation, not a promise about what happens in your case.
Is it safe to hold assets in a trust in Barbados?
How safe your assets are depends on who the trustee is, what the deed says and how the trust is run. Whether the trust holds against one particular claim hinges on timing, control and the courts where you live, and only your lawyer can weigh that. We promise no result. Have your lawyer vet the trustee and the deed before assets move.
Who are the settlor, trustee and beneficiaries?
Four roles appear in most deeds. The settlor sets the trust up and puts assets in. The trustee holds and manages them. Beneficiaries are those who may receive distributions. A protector, if the deed has one, oversees major trustee decisions. Your lawyer advises who should take each role.
Can the settlor also be a beneficiary?
Sometimes. A deed can be drafted that way where the law permits, and your Barbados lawyer confirms the present position. The risk is keeping so much that a court at home sees the assets as still yours. Your lawyer weighs that balance with you before you sign.
Does a trust in Barbados have to end on a set date?
How long a trust may last under Barbados law is a point your lawyer confirms for your case. Counsel reads the 2018 Act and the older International Trusts Act listing, then decides with you whether the deed should set an end date. Your lawyer raises it before drafting begins.
Can a foreign court order undo a trust in Barbados?
Your lawyer checks how Barbados law deals with a judgment from a foreign court. If you live abroad, your home court can still act against you personally. Ask your lawyer how far a home court could reach in your situation.
Setting up
The steps are the same for every client, and paperwork sets the speed. You pass identity and source-of-funds checks, shape the structure with your lawyer, approve the deed and sign it.
If your lawyer confirms that a filing is required, it is made before assets move. The slowest part is usually evidence of where the money came from, so gather it early.
The formation guide walks through the papers the trustee wants.
Do I need to visit Barbados?
Generally no. You sign before a notary in your own country and attend meetings by video. The trustee and counsel settle how signing works for you, so tell us in your first message about any travel limits. A bank may occasionally want a meeting in person, and we say so early.
Can a company hold the assets under the trust?
In many cases, yes. The trust can own a company that holds the assets, leaving the trustee with shares. That changes who signs documents and where records are kept. Your lawyer advises whether it suits your assets, and the choice affects the cost.
Running the trust
After funding, the trustee runs the trust under the deed, holding meetings, keeping accounts and passing resolutions. We prepare the papers behind each request before the trustee decides.
A sound structure is one where the deed is followed in daily practice and decisions are properly recorded. A settlor who spends trust money as personal money is a warning sign.
Keeping a trust running carries annual charges, and across its life they may exceed the set-up cost. The cost breakdown describes each item.
We publish the set-up fee for a standard trust; annual administration, event-based work and third-party charges are quoted after we review your case.
What does a trustee do in Barbados?
A trustee holds the assets, decides distributions under the deed, keeps accounts and deals with filings. It should work for real, through meetings and resolutions, and not merely countersign the settlor's requests. A trustee that approves everything without question is a warning sign.
Can I change the trustee later?
Usually the deed explains how a trustee is replaced, and sometimes a protector has that power. A change brings fresh checks, new paperwork and sometimes extra charges, so ask about notice periods and exit terms in advance. We put those questions to the trustee for you.
What happens if I move to another country?
Relocating can alter how your new country taxes you and may affect whether the trust still suits you. Speak to your lawyer and tax adviser before you go, not afterwards. We then inform the trustee, update the records and review the deed alongside your advisers.
Reporting and tax
Taxes follow the people concerned, so your country of residence decides your position. On the Barbados side, the work covers any filing your lawyer advises and the trust records.
For what the trustee or a bank must report, and what to file at home, ask your own tax adviser.
Do I pay tax on a Barbados trust?
Your country of residence decides the tax treatment for you as settlor or beneficiary, so put that question to your own tax adviser. We promise no tax result, and we do not stand in for your lawyer or adviser. How Barbados treats trusts for tax is a question for counsel.
Does a Barbados trust report to my tax authority?
Whether the trustee or a bank must report, for example under the Common Reporting Standard, is a point your lawyer confirms for your case. At the start, the bank is likely to ask for self-certification forms covering the trust and any company it owns.
Getting help
Begin with the Barbados guide for the overall view, or send your plan and we say what to prepare.
Ask for a quote whenever you like, and say where you live, what you want to hold and who the beneficiaries are.
Can you start my trust now?
Yes, you can begin with a quote. Share your plans and we explain what to prepare. We start as soon as your papers and identity checks are complete, and we confirm the start date in writing. A date is never promised before those checks are done.
Do you replace my lawyer or tax adviser?
No. Your lawyer and tax adviser at home judge whether a Barbados trust suits you, and a lawyer you hire in Barbados confirms which Act governs it. We work beside each of them from your first message and share the same drafts with all three of them and with you.
